2. What categories of personal data do we process?

LIFEPOWR may collect and process personal data about you in the course of our business, including through your use of our website, when you contact or request information from us, when you engage our services or as a result of your relationship with us as a supplier.

LIFEPOWR processes the following categories of your personal data as a natural person which it obtains directly from you via its website and (website) application:

  • Your personal identification information (e.g. your two first names, your surname, your date of birth and your place of birth);
  • Your place of residence and/or other location where the products/services will be delivered/installed;
  • FlexBox device ID;
  • Other personal contact information, including all information LIFEPOWR needs to contact you personally (such as your postal, billing and/or email address, and telephone number);
  • Your power meter number (EAN number) and the status of your power meter;
  • All measured and calculated data needed for providing balancing services;
  • Invoicing information (including VAT number if applicable);
  • Information about your orders and purchases at LIFEPOWR;
  • Processing of payments, your payment history and your bank account (IBAN/BIC) number;
  • Data relating to the management of your user account;
  • Your professional experience; and/or
  • Your academic record.

Processing is understood to mean any processing of data such as collection, recording, derivation, structuring, consultation, storage, sharing, transmission, deletion, archiving, etc.

This Privacy Policy does not apply to the processing of anonymous or company data.

3. Why do we process your data?

We will use the personal data you provide us with for the following purposes:

  • In order to be able to deliver our services to you, such as energy management process services and balancing services;
  • To be able to transfer your part of the Earnings to your bank account, for example to enter into an agreement with you, to process your order, to ensure the functionality of our products, to provide you with information on our similar products and services and to respond to your questions, inquiries and/or complaints;
  • To maintain the accuracy and relevance of your personal data;
  • To compile anonymized statistical data;
  • In the context of supplier and customer management;
  • In the context of our recruitment policies (job applicants);
  • To be able to comply with any legal obligations incumbent upon LIFEPOWR;
  • For research and statistics, since it is important for LIFEPOWR (i) to analyse which products and services interest its customers and how its website, (website) application, etc. is used, (ii) to optimise the customer experience and (iii) to improve LIFEPOWR's services. The provision of your personal data for this purpose is not strictly necessary and can be avoided by objecting (see below under section 8); and
  • Subject to your explicit permission, the sending of newsletters and possible advertising messages.

In the event the processing of your personal data is necessary for the performance of a contract, the provision of personal data shall be a requirement to enter into said contract with Lifpowr, and you will be obliged to provide said personal data to LIFEPOWR. In the event you would refuse or fail to provide the personal data necessary for the performance of said contract to LIFEPOWR, LIFEPOWR shall not be able to provide its services and shall be entitled to terminate the contract with immediate effect and without any compensation being due.

4. On what basis do we process these data?

We will process the personal data you provide us with for the above purposes because:

  • It is necessary to carry out a contract to which you are a party, and in particular the provision of our services in accordance with the FlexiO Terms of Use, or in order to take the steps at your request to enter into the Terms of Use;
  • It is necessary to comply with any legal obligation incumbent on LIFEPOWR;
  • We have a justified, legitimate interest in doing so, and in particular data processing is part of the normal operations of LIFEPOWR, taking great care to process only those data that are strictly necessary for the purpose for which we are processing them; and
  • We have your permission for processing your personal data for direct marketing purposes, such as the sending of newsletters and advertising messages.

5. To whom do we pass on your data?

LIFEPOWR does not transmit personal data except as described below. We may share your personal data with:

  • External service providers who perform services on our behalf on the basis of our instructions, such as our IT service provider, our accountant, other professional advisors we may collaborate with in specific matters;
  • Third parties engaged or involved in the services we provide to clients, such as, for example, your energy supplier, the distribution system operator (DSO), the transmission system operator (TSO) and/or the balancing responsible party (BRP);
  • Supplier to whom we may outsource certain (support) services; and
  • Authorities, such as regulatory authorities, courts, tribunals and governmental bodies. Note that, if the government carries out an investigation, we may share your personal information with the government if required by law. We may also disclose your personal information when absolutely necessary to prevent, detect or prosecute criminal activity.

These third parties will also process your personal data in compliance with the relevant rules and regulations, and, in the event such third parties qualify as controllers, for the purposes and the manners set forth in their respective privacy policies. These third parties might subsequently also transfer your personal data to other third parties. We recommend you to consult the privacy policies of these third parties and shall, upon your first request, provide you with a (digital) copy of these privacy policies.

If LIFEPOWR uses external parties for processing your personal data, it shall only use external parties that offer adequate safeguards ensuring that the processing complies with the legal requirements and without prejudice to your legal rights.

Please note, in particular, your personal data may be transmitted:

  • by LIFEPOWR to Elia Transmission Belgium NV (with registered offices at Keizerslaan 20, 1000 Brussels and with company number 0731.852.231; "Elia") in the event an intervention by Elia as TSO would be necessary in the context of LIFEPOWR's service provision; and
  • by LIFEPOWR to Fluvius System Operator CV (with registered offices at Brusselsesteenweg 199, 9090 Melle and with company number 0477.445.084) and/or any of its subsidiaries or related companies acting as a local DSO (together "Fluvius") in the event an intervention by Fluvius as DSO would be necessary for provision of the BSP services to LIFEPOWR in the context of LIFEPOWR's service provision.

In this event Elia or Fluvius will be the controller of the transmitted personal data and shall process your data for the purposes of providing the necessary balancing services and/or performing their duties as TSO or DSO. LIFEPOWR only processes your personal data within the European Economic Area, with the exception of following personal data, which may be transferred to a processor located in the United States of America: your name, your email address, your bank account number and our partner's email address. LIFEPOWR has implemented appropriate measures to ensure that all personal data remains protected and secure in accordance with applicable data protection laws and had entered into an agreement containing the standard contractual clauses (as approved by the European Commission) with the processor located in the United Stated of America. In the event LIFEPOWR would need to transfer personal data to (other) recipients located in countries outside the European Economic Area (EEA), and this would be to recipients established in countries which do not offer adequate protection of personal data, LIFEPOWR will implement appropriate measures to ensure that all personal data remains protected and secure in accordance with applicable data protection laws and shall, where required, LIFEPOWR enter into an agreement containing the standard contractual clauses (as approved by the European Commission) with such third parties located outside of the EEA. You may contact us if you wish to receive a copy of the agreement concluded with such third parties or to understand the other appropriate measures taken by LIFEPOWR.

We reserve the right to transfer your personal data in the event of a sale or transfer of all, or part of, LIFEPOWR's shares or assets. Should such a sale or transfer occur, we will use reasonable efforts to ensure that acquirer shall process your transferred personal data in a manner consistent with this privacy policy.

6. Protection of your personal data

LIFEPOWR uses a variety of technical and organisational measures to help protect personal data. We have implemented appropriate data collection and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of any personal data.

7. How long do we keep your data?

LIFEPOWR will not store your personal data for the stated purpose for longer than necessary, taking into account legal and regulatory requirements to retain the information for a minimum period, prescription periods, good practice and LIFEPOWR's business purposes. When the personal information we collect is no longer required, we will destroy or delete it in a secure manner.

Personal data concerning our clients will be retained for five years from the date of our last interaction with the client, but may be retained for a longer period of time if necessary for compliance with regulatory obligations or in relation to our professional liability.

For job applicants, the personal data will only be retained for a period of two years should the candidate not be successful.

For suppliers, personal data may be stored for a period of maximum ten years after termination of our relationship.

8. What rights do you have?

You have certain rights and choices in relation to the personal data we collect from you.

As a matter of principle, you have the right to access, correct or delete your personal data.

In addition, you have the right to withdraw your consent, if previously provided, to the data processing or to object to the processing of your personal data by LIFEPOWR based on a legitimate interest.

You can in any case object to any processing of your personal data for the purposes of direct marketing.

You have the right to data transfer. This means that you can submit a request to us to send the personal data we hold about you in a computer file to you or another organisation you have mentioned.

You have the right to limit the processing of your personal data if (i) you dispute the accuracy of the personal data, (ii) the processing is unlawful and you oppose the erasure of the personal data, (iii) we no longer need your data for the processing purposes, but you still need them for the institution, exercise or substantiation of an action, (iv) you have objected to the processing on the grounds of the legitimate interests of LIFEPOWR.

You may send a request through the contact form on our website for access, correction, deletion, data transfer or limitation of your personal data or a request to withdraw your consent or objection to the processing of your personal data.

To ensure that the request for inspection has been made by you, we ask that you enclose a copy of your identity card with the request. In this copy, make your passport photo, MRZ ("machine readable zone", the strip with numbers at the bottom of the passport), passport number and national register number black. This is to protect your privacy.

LIFEPOWR is committed to responding as quickly as possible, and at least within 30 days, to your request. In the event the complexity and/or number of requests would require an extension of this term, LIFEPOWR shall inform you, within (30) days of the receipt of your request, of the extension of this term (which shall not exceed two months), together with the reasons for the extension.

LIFEPOWR would also like to draw your attention to the fact that you have the possibility of lodging a complaint with the national supervisory authority.
